Domestic Abuse

Domestic abuse is a serious criminal offence, yet victims are often frightened or reluctant to come forward. Our team understand the pain and distress caused by domestic abuse and take rapid action to ensure the protection of you and your loved ones.

Domestic Abuse & Injunctions

Just because you aren’t suffering from physical violence doesn’t mean it isn’t domestic abuse.
Domestic abuse also includes emotional abuse, verbal abuse, sexual abuse, mental abuse and harassment.
If you are suffering from any form of abuse then the first step is to report matters to the police and once this is done you can look to seek legal advice to ensure you are never in the same position again.

Injunctions

We will be able to offer advice and assistance in making an application to Court for an Injunction which is also known as a Non-Molestation Order. This is a Court Order which prohibits the perpetrator from doing certain acts of abuse towards you. This can prevent you being followed, spoken to, contacted via text message, email or facebook. It can also prevent someone from coming to your home and can set an exclusion zone around your home.

Breach of a Non-Molestation Order is also a criminal offence which means that the Police can take action and enforce the Order themselves through the Criminal Courts.

The law on Non-Molestation Orders is complex however we can advise you as to whether or not you have grounds to obtain an Injunction, prepare all of the necessary paperwork and represent you in Court.

Occupation orders

At GWBHarthills we understand that many people suffer abuse at the hands of someone they live with. An Occupation Order can be obtained forcing your ex-partner to leave the home and not to return to it.
Quite often both a Non-Molestation Order and Occupation Order are required to protect you from further ongoing domestic abuse and again we can help you with the paperwork and represent you in Court.
